monday. >> now, james holmes made his first court appearance yesterday and now prosecutors are going to talk to the family member of the victims about whether to pursue the death penalty. fox 5's lauren demarco is in the newsroom now with the details. >> reporter: the shooting left 12 people dead, dozens injured and a community heart broken. yesterday was the first time the public got a look at james holmes since he allegedly walked into the century 16 movie theater and opened fire. the 24-year-old and in court to hear a judge explain why he is being held without bond. holmes with his hair still died that orange-red was offer a chance to speak but he stayed quiet. he sat as though in a daze in the colorado courtroom. at one point, he even seemed to doze off. holmes is being held in solitary confinement. authorities say he is refusing to cooperate and it could take months to learn what prompted friday's horrific shooting rampage and a midnight screening of the dark knight rises. the defendants will likely argue that the suspect was not in good mental health at the time of the shooting

the apartment of james holmes, the suspected colorado shooter. a law enforcement official has described to cnn video taken from inside the apartment. he said it was set up like something from iraq or afghanistan. 30 improvised grenades rigged to a control box in the kitchen and gas containers filled with ten gallons of gas, allegedly for the purpose of adding more fuel to the fire in an explosion. cnn's jim spelman is in aurora, colorado, right outside the theater where the shooting happened. the description of the apartment is extraordinary and terrifying. what else do you know about it? >> reporter: just trying to picture 30 of the home-made grenades filled with black powder and gas containers around to amplify the fire after these things went off. all set to a srs of trip wires. one set to go off when the first person who goes in opens the door. it took them almost two days to come up with a strategy to eliminate them. ultimately they used water to disrupt the control box. these things were so volatile, they had to carry each one out in a bucket of sand to a dump truck, take them out into t

. shooting.a court document released friday showed that james holmes was a patient of psychiatrist lynne fenton. the information was revealed in a request from the 24-year-old suspect that investigators hand over a package he sent to doctor fenton on grounds it was a protected communication. the package was seized during a search last week. a former denver prosecutor agrees with holmes' request saying it does fall under doctor-patient confidentiality... but a psychologist disagrees. hours from the moment they went in to james holmes' apartment, they were able to start taking away the evidence and the belongings from what we can tell, they have completely cleared out his apartment. a law enforcement source tells cnn, they removed interestingly enough a batman poster, a batman mask, and his computer. all of that has been taken away from the apartment. and obviously, they're going through that computer, trying to see what kind of evidence they might be able to find. they're hoping that would be a type of clue that would provide a great deal of evidence. and depth into what exactly james holmes has been doing for the last several months in preparing for this attack. don? >> we also learned something about the weapon used in that theater. what do police say about that? >> well, we had heard from one of the shooting victims, they believe that at some point, one of the weapons that james holmes was using inside the theater had jammed. we're told by a law enforcement source that appears to be the case. it was the ar-15 assault rifle that jammed at some point and this

in the suspect's apartment. jim? >> one thing that everyone is talking about in the demeanor of james holmes in the courtroom. on front page of every paper. his red hair, his big eyes. you were inside the court, jim, what did it seem like to you? >> we didn't know what to expect. the first question on everybody's mind is would his hair be red. we had heard that from law enforcement sources. all the witnesses who were in the theater say he was wearing a helmet and mask. so that was the first thing was seeing his red hair after he described himself as the joker. this guy just looked dazed, he looked weak. he looked small to me and after initially scanning the crowd when he walked in, the rest of the time he more or less just looked straight ahead. meantime back in the seats of the courtroom. family members could not take their eyes off him. i saw parents of people who had died just staring at him the whole time. and you could tell it was a very emotional time for them. and they're there in the courtroom where they can't show any kind of emotional all. they have to be quiet. very typical for th

. james holmes is expected to be formally charged in the case. 12 people died, 58 others were injured. dave mattingly joins us live outside the courthouse. dave, what are we expecting tomorrow? >> reporter: well, tomorrow the prosecution is going to set the tone with how this case is going to be heading through the courts here in colorado. what we're expecting to hear with 12 people killed, that's 12 potential premeditated murder charges we could hear tomorrow. 58 wounded in that theater could mean dozens of potential attempted murder charges. we're also going to be watching closely to see if there's any sort of decision made about the mysterious package the alleged killer sent to his psychiatrist at the university of colorado. that package now in the possession of authorities. the defense says that could contain privileged communication between a patient and his doctor and may not be released into evidence. we're going to see if the judge is going to rule on this if he allows the contents of that package into evidence, and if so, how. >> and, david, police say holmes had rigged his a

in the university of colorado mail room that appears to have been mailed by the suspected shooter, james holmes. cnn's ed lavandera is in aurora for us. ed, what do we know about this package? >> reporter: well, we're still trying to gather information on what exactly is inside that package, wolf. but as you mentioned that law enforcement official telling cnn that on monday police and fbi discovered a package that was apparent apparently sent by james holmes, the 24-year-old suspected gunman. now it's unclear obviously if this package was indeed sent by him, it was clearly sent before he was taken into custody. it arrived at some point on monday at the university mail room. we've also been told by hospital officials over the last couple of days this is something we've been monitoring for some time that there were two packages that were suspicious and were being looked into, one found in the mail room and also one that was actually delivered to a university professor. so we've been trying to nail down more information on this. and we'll continue to do so, wolf. >> what's the university of colorado sa
